    Most people know that California doesn't enforce non-competes.     Have You Ever Signed a Noncompete?Noncompetes in the US are still legally enforceable under some circ*mstances, but the legal trend for noncompetes is that they are hard to enforce, especially against lower-wage workers. One reason for this legal trend is that there is more of a power disparity between an employer and a lower-wage worker, compared to a high-earning executive who likely has the ability to negotiate their employment terms.My firm, Lipp Law, helps companies and executives with noncompete issues throughout DC, Maryland, and Virginia - so we review and draft noncompetes regularly to protect our clients. We also get involved in noncompete disputes, cease and desist letters and responses, and noncompete litigation.Among DC, Maryland, and Virginia, DC has the most restrictive noncompete laws. In 2022, DC passed a new noncompete law stating that anyone making less than $150K cannot be held to a noncompete ($250K for medical specialists). DC's noncompete law is not retroactive, meaning that noncompetes signed before the law went into effect can still be enforced.Virginia and Maryland have banned noncompetes for lower-wage workers.     The proposed time-limit on non-competes is intended to help promote market mobility and, in theory, should drive wages up - employees will be able to move on more easily, encouraging employers to boost salaries for both retention and recruitment purposes. But it remains to be seen whether employers might look to restrain employees in other ways, by implementing longer notice periods and garden leave.It will also be interesting to see what approach is taken by the legislature in implementing this time-limit. Will it only impact future non-competes? Or will it have a retrospective effect on existing non-competes, capping them at three months or even voiding them entirely?

    On May 16, 2023, Minnesota passed a law banning non-compete agreements in employment contracts, echoing similar measures adopted in other states limiting such restrictive covenants. Given the magnitude of the proposed changes, employers are advised to monitor developments closely and prepare for the July 1, 2023 effective date. It is imperative that employers consult with legal professionals to ensure that their practices align with the new law and protect their interests effectively.https://bit.ly/3Je8FLV

    Yesterday, the FTC issued its Final Rule banning non-compete agreements. The Final Rule is already being challenged in court and if it survives, will not go into effect for several months. Employers should be aware of the impact that the Final Rule, if it survives legal challenges, will have on their business.
